General Terms & Conditions

By placing an order through this website you are agreeing to the following conditions:
We accept payment by MasterCard or Visa.
All wines are sold subject to availability, any vintage or price changes will be notified prior to processing and dispatch.
Orders are normally dispatched within three working days from receipt of order using the most cost effective carrier depending upon your location.
We reserve the right not to dispatch wines in exceptionally hot weather or prior to long weekends to ensure your order is delivered to you in the best condition and in a timely manner.

It is illegal to sell wine to anyone under the age of 18. By placing an order with the Stewarts Wine Co you confirm that you are at least 18 years of age. Remember, it is an offence to obtain liquor on behalf of a person under the age of 18 years; this includes purchasing the wines as a gift. If in doubt our couriers may request some form of ID with proof of age at the time of delivery.

We reserve the right to change our terms and conditions from time to time.

Freight Costs & Conditions

Orders are normally dispatched within three working days from receipt of order using the most cost effective carrier depending upon your location.
We reserve the right not to dispatch wines in exceptionally hot weather or prior to long weekends to ensure your order is delivered to you in the best condition and in a timely manner.
We have a ‘Freight Calculator’ on the first page of your shopping cart, entering your postcode into the calculator will give you your freight cost. Freight is calculated per dozen of 750ml bottles unless stated otherwise.
We do not service all regions of Australia at this time. Those that may not be included are Western Australia, Northern Territory and some more remote area’s of South Australia and the Eastern states.
We reserve the right to cancel and refund orders with abnormal freight demands or costs.
On occasion we may enquire via email if we deem that some extra delivery instructions are required before sending to ensure the safe delivery of your shipment.

 

Stewarts Wine Co Cellar Club Terms and Conditions

Introduction

These Terms and Conditions form the basis of the Stewarts Wine Co Cellar Club.

1.0 Membership
1.1. Membership is free. A person can apply to become a Stewarts Wine Co Cellar Club member (“Member“) by completing details online at (www.stewartswineco.com.au)
1.2. Members will be bound by these Terms and Conditions which may be varied from time to time.
1.3. A Member must notify Stewarts Wine Co of any change of address or of a lost or stolen membership card. Stewarts Wine Co is not liable for any delay in replacing a membership card or for any unauthorised use of a membership card.
1.4. Reward points will not be credited until an individual becomes a Member. Members can confirm the number of points held by them by checking online. Disputes about any details regarding Member points must be notified to our membership team (info@stewartswineco.com.au). A written statement by Stewarts Wine Co deciding any such dispute is final and binding.
1.5. Stewarts Wine Co may terminate a membership without notice for any reason including, without limitation, if the Member:
1.5.1. Fails to comply with these membership Terms and Conditions
1.5.2. Abuses any privilege accorded to the Member : or
1.5.3. Supplies any misleading information or make any misrepresentations to Stewarts Wine Co staff or management
1.5.4. If the Member does not use his or her membership card for a period of 12 months or dies.
1.6. A Member may terminate his or her membership at any time by giving written notice to our membership team (info@stewartswineco.com.au)The Member’s points will be cancelled 12 months after receiving the notice and the Member’s details will be deleted from the membership database.
1.7. Membership cards are not credit or charge cards, are not transferable, and remain the property of Stewarts Wine Co and must be returned to Stewarts Wine Co if a Member ceases to be a part of the scheme.
1.8. Any tax, liability, or duty arising from a Member’s participation in the Stewarts Wine Co Cellar Club membership program is the responsibility of the Member.

2.0 Earning points and Redeeming points
2.1. Points will be credited to a Member’s account for redemption of rewards by the Member from Stewarts Wine Co on qualifying goods or services. Promotional and incentive programs, including higher than the standard rate of points per dollar spent, may be offered from time to time.
2.2. Stewarts Wine Co will determine which goods or services are qualifying goods and services and the number of points that will be credited to a Member’s account for such redemption. As at 1 August 2011, the rate shall be 1 point for each $1 spent at Stewarts Wine Co.
2.3. A Member must present his or her membership card to Stewarts Wine Co staff before the purchase is concluded. Failure to present the membership card will result in no points being credited to the Member’s account for the purchase.
2.4. Points cannot be redeemed as cash.
2.5. Points will not be accrued upon purchases made with points.
2.6. 500 points are automatically credited to your account on becoming a Member after visiting the website and when all the required details are filled in online. Other limitations on when a member is enabled to redeem their points may also apply. Stewarts Wine Co may change the amount of bonus points at anytime or remove the bonus point promotion at anytime.
2.7. Accrued points will only be redeemable when a member has spent at least $250.00 at a Stewarts Wine co store using their member card. The minimum spend of $250.00 can be changed at anytime by Stewarts Wine Co.


3.0 Other deductions of points
3.1. Stewarts Wine Co may deduct from the points balance in a Member’s account any points credited in error and any points relating to a purchase which is cancelled or reversed or where a refund is given.
3.2. Any points not redeemed within 12 months after the end of the month in which the points were credited to that account will, at the discretion of Stewarts Wine Co, expire and will be deducted from the points balance in a Member’s account.

4.0 General
4.1. Stewarts Wine Co may make any changes at any time without prior notice to Members to these Terms and Conditions and the award schedule. Stewarts Wine Co will attempt to notify Members of any changes but shall not be liable in any way for failure to do so. Stewarts Wine Co will determine the minimum number of points required to be held by a member before points can be redeemed.
4.2. Stewarts Wine Co may without prior notice to Members, change those goods and services which qualify for points and the number of points that attach to those goods and services.
4.3. Stewarts Wine Co reserves the right to suspend or terminate the membership program at any time without prior notice. Stewarts Wine Co will not be liable for the suspension or termination of the program on any account whatsoever including (without limitation) for any points balance in a Member’s account at the time of suspension or termination.
4.4. Stewarts Wine Co assumes no liability to a Member whether for negligence, breach of contract or otherwise except :
4.4.1. any claim relating to points, to crediting that number of points to the Member’s account.
4.5. A notice shall be deemed to be given by Stewarts Wine Co to a Member if it is sent to the postal or e-mail address of the Member appearing in the Member database.
4.6. These terms and conditions will be construed according to and be governed by the laws of Queensland. The parties submit to the exclusive jurisdiction of the courts in and of Australia in relation to any dispute arising under these terms and conditions.

5.0 Privacy Statement
5.1. Stewarts Wine Co may collect information about Members including information contained in the application form and information as to transactions resulting in points credits and debits which will be held in the membership database. The membership database contains the following Member information:
5.1.1. Name, address & telephone number(s)
5.1.2. Transaction details associated with the collection of membership program points
5.1.3. Points collected and rewards provided.
5.1.4. E-mail address

A Member may access the information and update details on the Member held by Stewarts Wine Co and by logging into our website.
5.2. Information from the Member database will be made available to Stewarts Wine Co agents involved in administering the membership program including agents producing cards and points summaries and data processing. Information from the membership database will also be made available to and used by Stewarts Wine Co and its agents, for marketing (direct and all other kinds), planning, product development, research and other commercial purposes.
5.3. Each Member consents and agrees to:
5.3.1. Stewarts Wine Co and its agents accessing the information contained in the Member database;
5.3.2. The disclosure of any information contained in the Member database to Stewarts Wine Co and its agents for the purposes set out above.
5.3.3. Stewarts Wine Co may charge $5.00 to replace a card if it is stolen, lost or misplaced.
5.3.4. Stewarts Wine Co may allow a Member to redeem points from the Members account to replace a lost or stolen card.
